Welcome to Trucking Talent LLC (“Trucking Talent,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of Trucking Talent websites, job board, driver accounts, application forms, employer dashboard, landing pages, communications, integrations, and related recruitment services, collectively referred to as the “Platform.”
By accessing or using the Platform, creating an account, submitting information, applying to a job, or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
If you use the Platform on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
1. Eligibility
You must be at least 18 years old and located in the United States to use the Platform.
By using the Platform, you represent that you meet these requirements and that the information you provide is accurate and complete.
2. Nature of the Platform
Trucking Talent provides recruitment technology, driver acquisition, job board, application routing, dashboard, advertising, pre-screening, communication, and ATS integration services for the trucking industry.
For drivers, the Platform allows you to create an account, provide job-related information, view job opportunities, apply to specific jobs, and communicate with Trucking Talent or employers.
For employers, the Platform helps collect, organize, pre-screen, and deliver driver applications for specific job opportunities.
Trucking Talent is not:
- an employer;
- a staffing agency;
- a motor carrier;
- a freight broker;
- a background screening company;
- a consumer reporting agency;
- or a party to any employment agreement between drivers and employers.
Trucking Talent does not make final hiring decisions. Final hiring decisions, employment offers, onboarding, background checks, DOT compliance, and employment relationships are solely between drivers and employers.
3. Accounts and Access
To access certain features, you may need to create an account or receive dashboard access.
You agree to:
- provide accurate, complete, and current information;
- keep your login credentials confidential;
- promptly update information if it changes;
- use the Platform only for lawful purposes;
- notify us if you believe your account has been accessed without authorization.
We may require verification of your email address, phone number, company information, or other account details.
We may suspend or terminate accounts that contain false, misleading, outdated, fraudulent, or unauthorized information.
If a company uses a shared dashboard account, the company is responsible for all activity under that account. If individual user accounts are provided, each user is responsible for their own login credentials.
4. Driver Accounts and Applications
Drivers may create a Trucking Talent account to manage their profile, view jobs, review positions they applied to, and see job opportunities that may fit the information they provided.
Trucking Talent is not a public driver profile marketplace. Employers cannot browse or search all driver profiles. A driver’s application information is made available to an employer when the driver applies to that employer’s job.
By applying to a job through the Platform, you authorize Trucking Talent to:
- process your application;
- share your application information with the employer connected to that job;
- display your application in that employer’s Trucking Talent dashboard;
- send your application information to that employer’s ATS or recruiting system, where applicable;
- contact you about the application, related jobs, full application links, account matters, and related services.
Drivers are responsible for the accuracy of the information they provide. Trucking Talent may reject, remove, or suspend applications or accounts that appear false, misleading, incomplete, fraudulent, abusive, or inconsistent with these Terms.
5. Employer Dashboard and Candidate Data
Employers may use the Platform to view applications submitted to their jobs, manage candidate information, add notes or statuses, download or export application information where available, and receive applications through an ATS or recruiting system.
Employers agree to use driver and applicant information only for legitimate recruiting, hiring, compliance, and related business purposes.
Employers must not:
- resell driver information;
- redistribute driver information to unauthorized third parties;
- use driver information for unrelated marketing or solicitation;
- scrape, harvest, copy, or misuse data from the Platform;
- contact drivers in a way that violates applicable law;
- use the Platform or candidate data for discriminatory, unlawful, deceptive, abusive, or fraudulent purposes.
Employers are responsible for their own hiring practices, job postings, job requirements, screening criteria, communications, compliance obligations, and employment decisions.
6. Pre-Screening and Candidate Information
Trucking Talent may help pre-screen drivers based on information submitted by drivers and criteria provided by employers.
Pre-screening may include job-related questions about experience, CDL class, route preferences, trailer experience, home time, employment preferences, accident count, violation count, DUI/DWI-related answers, or other job-specific qualifications.
Unless expressly stated in a separate written agreement, Trucking Talent does not independently verify all driver-provided information and does not provide background checks, MVR reports, PSP reports, DOT driver qualification files, consumer reports, medical card verification, Clearinghouse checks, or employment verification.
Employers are solely responsible for determining whether an applicant meets their requirements and for conducting any background checks, MVR/PSP checks, DOT compliance checks, or other legally required screening.
7. ATS Integrations and Third-Party Services
Trucking Talent may send application information to an employer’s ATS or recruiting system, including Tenstreet or other systems selected by the employer.
ATS integrations may be one-way, where Trucking Talent sends applications to the ATS, or two-way in the future, where Trucking Talent may receive limited application status or workflow updates from the ATS.
Employers are responsible for their ATS accounts, ATS configuration, ATS permissions, and use of application information after it is sent to the employer or the employer’s ATS.
The Platform may contain links or connections to third-party websites, ATS platforms, employer websites, job application systems, payment processors, messaging platforms, social media platforms, or other third-party services. Third-party services are governed by their own terms and privacy policies. Trucking Talent is not responsible for third-party services.
8. Full Employment Applications
After applying to a job through Trucking Talent, a driver may be invited to complete a full employment application through the employer’s ATS or another third-party application provider.
Trucking Talent does not collect or store full DOT employment applications through its standard Platform forms. Full employment applications submitted outside Trucking Talent are controlled by the employer and/or the applicable ATS or application provider.
Drivers should review the employer’s and/or ATS provider’s terms and privacy practices before submitting a full application.
9. Communications and Consent
We may communicate with drivers and company users by email, SMS, phone, Messenger, chatbot, in-app message, or other communication channels.
Driver communications may include account messages, verification messages, application confirmations, full application links, job application follow-ups, job-related updates, messages about positions the driver applied to, messages about other job opportunities, support messages, and marketing or promotional messages where permitted by law.
Where required by law, we will obtain consent before sending certain marketing, recruiting, automated, prerecorded, artificial voice, or AI-assisted calls or messages.
Message frequency may vary. Standard message and data rates may apply.
You may opt out of marketing or recruiting SMS messages by replying STOP, where available. You may also opt out by using unsubscribe links, Messenger unsubscribe options, or by contacting us at [email protected].
After an opt-out, we may still send limited transactional or service-related messages where permitted by law, such as account, security, application, or legal notices.
Employers may contact drivers directly using the contact information provided in an application. Trucking Talent does not control communications sent directly by employers.
10. Company Subscriptions, Fees, and Payment
Company users may purchase access to Trucking Talent services through monthly plans, subscriptions, order forms, invoices, service agreements, or other written arrangements.
Fees, payment terms, renewal terms, cancellation terms, included services, job post limits, dashboard access, ATS integrations, advertising services, and other commercial terms may be stated in a separate order form, invoice, service agreement, or written agreement between Trucking Talent and the company.
If there is a conflict between these Terms and a separate written agreement signed or accepted by Trucking Talent and a company client, the separate written agreement will control for that company’s paid services.
Trucking Talent may suspend or limit company access for non-payment, misuse of the Platform, violation of these Terms, or as otherwise stated in the applicable agreement.
Unless expressly stated in a separate written agreement, Trucking Talent does not guarantee any specific number of applications, interviews, hires, conversion rates, cost per application, or hiring outcome.
11. Acceptable Use
You agree not to:
- use the Platform for unlawful, deceptive, fraudulent, abusive, or harmful purposes;
- misrepresent your identity, qualifications, company, authority, or hiring needs;
- submit false, misleading, incomplete, or unauthorized information;
- interfere with the operation, security, or performance of the Platform;
- attempt to access accounts, systems, or data without authorization;
- scrape, harvest, copy, or extract data from the Platform;
- upload malware or harmful code;
- use the Platform to violate the rights of Trucking Talent, users, employers, drivers, or third parties;
- use the Platform in a way that violates applicable employment, privacy, communication, advertising, anti-discrimination, transportation, or data protection laws.
We may investigate suspected violations and take any action we believe is appropriate, including removing content, restricting access, suspending accounts, terminating accounts, or cooperating with legal authorities.
12. User Content and License
You are responsible for the information, materials, job details, application answers, messages, notes, files, or other content you submit through the Platform (“User Content”).
You represent that you have the right to submit your User Content and that it does not violate law, these Terms, or the rights of any third party.
You retain ownership of your User Content. However, you grant Trucking Talent a non-exclusive, worldwide, royalty-free license to host, store, process, display, transmit, reproduce, and use your User Content as needed to operate the Platform, provide services, process applications, deliver applications to employers or ATS providers, support users, improve the Platform, comply with law, and enforce these Terms.
13. Intellectual Property
The Platform, including its software, design, layout, text, graphics, logos, trademarks, features, workflows, databases, and other content, is owned by or licensed to Trucking Talent and is protected by intellectual property and other laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, create derivative works from, or exploit any part of the Platform without our prior written consent.
You may not use Trucking Talent’s name, logo, trademarks, or branding without our prior written permission.
14. No Guarantees
The Platform is provided to support recruitment workflows, but Trucking Talent does not guarantee:
- that a driver will receive a job offer;
- that an employer will contact, interview, hire, or retain any driver;
- that any job posting will remain available;
- that any employer or driver information is complete, accurate, current, or verified;
- that any employer will meet a driver’s expectations;
- that any driver will meet an employer’s expectations;
- that any campaign, job post, or service will produce a specific number of applications, interviews, hires, or results;
- that the Platform will be uninterrupted, error-free, or available at all times.
Any projections, estimates, examples, expected results, marketing statements, or past performance examples are for informational purposes only and are not guarantees of future results.
15. Suspension and Termination
We may suspend, restrict, or terminate access to the Platform at any time if we believe:
- you violated these Terms;
- you provided false, misleading, or fraudulent information;
- your use creates legal, security, operational, reputational, or compliance risk;
- your company failed to pay required fees;
- suspension or termination is required or permitted by law;
- continued access may harm Trucking Talent, users, employers, drivers, service providers, or third parties.
Drivers may delete their account where this feature is available. Company clients may terminate services as stated in the applicable order form, invoice, service agreement, or written agreement.
Termination does not affect rights or obligations that accrued before termination.
16. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.
By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
17. Disclaimer of Warranties
To the maximum extent permitted by law, the Platform and services are provided “as is” and “as available.”
Trucking Talent disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.
Some jurisdictions do not allow certain warranty disclaimers, so some of these disclaimers may not apply to you.
18. Limitation of Liability
To the maximum extent permitted by law, Trucking Talent will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, hiring outcomes, employment disputes, or unauthorized access to or misuse of data by third parties.
To the maximum extent permitted by law, Trucking Talent’s total liability for any claim arising out of or relating to these Terms or the Platform will not exceed the greater of:
- the amount you paid to Trucking Talent, if any, during the twelve months before the claim arose; or
- $100.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Trucking Talent, its owners, officers, employees, contractors, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Platform;
- your violation of these Terms;
- your User Content;
- your violation of law;
- your violation of another person’s rights;
- your interactions, communications, hiring decisions, employment decisions, or disputes with another user, driver, employer, or third party.
For company users, this obligation also applies to claims arising from job postings, hiring criteria, candidate communications, employment decisions, background checks, DOT compliance, payment obligations, and use of driver information.
20. Dispute Resolution, Arbitration, and Class Action Waiver
Please review this section carefully. It affects your legal rights.
Before filing a claim, you and Trucking Talent agree to try to resolve the dispute informally by contacting the other party and providing a reasonable description of the dispute.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or our services will be resolved by binding arbitration on an individual basis, rather than in court.
You and Trucking Talent waive the right to participate in any class action, class arbitration, representative action, private attorney general action, or consolidated proceeding.
This section does not prevent either party from bringing an individual claim in small claims court where permitted, or from seeking temporary or preliminary injunctive relief in court for intellectual property, security, unauthorized access, or misuse of confidential information.
This arbitration section should be reviewed by legal counsel before publication to confirm the preferred arbitration provider, rules, fees, location, and any required consumer-specific terms.
21. Governing Law and Venue
These Terms and any dispute arising out of or relating to the Platform or services will be governed by the laws of the State of Illinois, without regard to conflict of law principles.
To the extent any dispute is not subject to arbitration, you agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
22. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on the Platform with a revised “Last Updated” date.
Your continued use of the Platform after updated Terms are posted means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Platform.
